В статье рассматривается специфика та- ких источников материального и процессуального права, как договоры купли-продажи и судебные документы пер- вой половины II тыс. до н.э. из старовавилонского царс- тва. При исследовании недвижимости как объекта права в содержании документов не всегда наблюдается сущест- венная разница между полным и частичным отчуждением имущества. Большая часть судебных документов близка по структуре и содержанию к виндикационным искам.
The article considers the features of such sources of substantive and procedural law as Babylonian sale contracts and judicial documents of the first half of the second millennium BC. The structure of the contracts dating back to the beginning of this period is fully-formed. However, the study of documents on real estates as objects of rights does not always reveal a significant difference between full and partial alienation of property. Most of judicial documents are similar in structure and content to the replevins of classical Roman Law.
